1. Purpose & Applicability
This Policy governs all donations, contributions, sponsorships, program fees, and payments made to Anshumat Foundation (“Foundation,” “we,” “our,” or “us”).
It applies to:
- Donors – Individuals/entities contributing funds, goods, or services.
- Sponsors/Partners – Corporates or institutions providing CSR, financial, or in-kind support.
- Participants/Beneficiaries – Individuals enrolled in paid programs, training, or events.
- Supporters – Any person or entity making monetary transactions with the Foundation.
2. Nature of Donations & Payments
- Donations made to the Foundation are treated as voluntary, non-refundable charitable contributions under applicable laws.
- Program/event fees, sponsorships, or services provided by the Foundation may involve specific terms of engagement communicated separately.
- Where applicable, donations may qualify for tax exemptions under Section 80G of the Income Tax Act, 1961, subject to valid registration and issuance of certificate.
- Donations may be earmarked for specific causes/projects or contributed as general-purpose funds.
3. Accepted Modes of Payment
The Foundation accepts contributions via:
- Online payment gateways (Credit/Debit Cards, Net Banking, UPI, Wallets)
- Bank transfers (NEFT/RTGS/IMPS)
- Cheques/Demand Drafts payable to Anshumat Foundation
- International donations (subject to FCRA compliance, if applicable)
4. Acknowledgement & Receipts
- For every successful transaction, the Foundation issues a digital receipt.
- Donors who seek tax exemption certificates must provide valid PAN and contact details.
- Corporate/CSR contributions will be supported with formal agreements and acknowledgement letters.
5. Donation Cancellation Policy
- Non-Refundable Clause:
- All voluntary donations to Anshumat Foundation are final, non-refundable, and non-transferable.
- Once a donation is processed, the donor shall have no right to request refund, cancellation, chargeback, or adjustment against any other contribution or service.
- Refunds will not be issued for deliberate or authorized donations.
- Exceptions (Error-Only Cases):
Refunds may only be considered under the following circumstances:- Duplicate donation due to technical error.
- Erroneous transaction caused by payment gateway/system failure.
- Fraudulent/unauthorized transaction (e.g., stolen card use), subject to verification.
- Requests under exceptions must be raised within 7 calendar days of the transaction, with valid proof.
6. Program/Event Fee Cancellation Policy
- If a participant cancels enrollment:
- 15 days or more prior to the start: Refund may be issued, but up to 50% may be deducted as administrative costs, and only on the portion of fees designated as Refundable Fees.
- After commencement: No refund permitted.
- If the Foundation cancels a program/event:
- A full refund will be issued to all registered participants.
- Any non-refundable portion of the fee (if explicitly declared in advance) shall not be subject to refund under any circumstances.
7. Refund Process
- Verified refunds will be initiated within 7–10 working days.
- Refunds will be processed to the original payment method. Where not possible, refunds will be made via bank transfer to the donor’s verified account.
- The Foundation reserves the right to seek additional documentation before processing refunds in case of disputed or suspicious transactions.
8. Non-Refundable Contributions
The following shall always remain non-refundable and non-adjustable:
- Voluntary donations (except error cases above).
- In-kind contributions (goods, services, materials).
- CSR funds or earmarked grants once allocated.
- Donations made in response to appeals, campaigns, or fundraisers.
9. Chargebacks & Disputes
- Donors agree not to dispute or raise chargebacks on voluntary donations made in good faith.
- The Foundation reserves the right to challenge any chargeback claims that violate this Policy.
- All disputes shall be subject to the jurisdiction of competent courts at Paschim Bardhaman, West Bengal, India.
10. Data Privacy & Security
- The Foundation may collect and store certain sensitive payment information, including card details, bank account numbers, and transaction records, where required for lawful processing, compliance, recurring donations, or accounting purposes.
- All such information is handled with strict confidentiality and industry-standard safeguards, including encryption, access controls, and secure servers.
- The Foundation undertakes to comply with applicable data protection laws, RBI guidelines, and PCI-DSS standards for handling payment data.
- Sensitive financial details will not be disclosed, shared, rented, or sold to any unauthorized third party.
- Retention of such information will be limited to what is necessary to:
- Complete transactions, audits, or statutory obligations.
- Fulfil donor requests for recurring donations or receipts.
- Comply with applicable laws.
- Donors may request deletion of stored payment details, subject to legal and regulatory requirements.
