Intellectual Property, Copyright & Brand Usage Policy

This Intellectual Property, Copyright & Brand Usage Policy (“Policy”) constitutes a legally binding agreement between Anshumat Foundation, its arms (including but not limited to EdTech, Career Tech, WealthTech, Civic Tech, and Social Tech), and its associates (hereinafter collectively referred to as “the Foundation”) and any person, entity, user, partner, volunteer, donor, or third party (hereinafter referred to as “User”) accessing, using, or engaging with the Foundation’s platforms, services, or materials.

By accessing or using the Foundation’s platforms, content, or services, the User hereby agrees to be bound by the terms of this Policy, in addition to any other applicable terms and conditions.


1. Ownership of Intellectual Property

1.1 All rights, title, and interest in and to the content, trademarks, trade names, logos, brand elements, symbols, graphics, designs, photographs, videos, audio, software, documentation, source code, course materials, and any other works (“Intellectual Property” or “IP”) made available by the Foundation are and shall remain the sole and exclusive property of the Foundation, unless otherwise expressly stated.

1.2 No rights, titles, or interests in any Intellectual Property are transferred to the User by virtue of access, use, or participation, except as expressly provided under this Policy.


2. Copyright

2.1 All original works of authorship produced, published, or made available by the Foundation are protected under the Indian Copyright Act, 1957, the Trademarks Act, 1999, and applicable international intellectual property treaties.

2.2 The User shall not reproduce, distribute, modify, adapt, translate, publish, publicly perform, display, or exploit any copyrighted material of the Foundation, in whole or in part, without prior written authorization.

2.3 Any unauthorized use shall constitute an infringement of the Foundation’s rights and may result in civil and/or criminal liability under applicable laws.


3. Trademarks & Brand Usage

3.1 The names, marks, logos, designs, slogans, and taglines of the Foundation, including those pertaining to its arms (EdTech, Career Tech, WealthTech, Civic Tech, Social Tech), are trademarks and/or service marks, whether registered or unregistered, owned by the Foundation.

3.2 The User is expressly prohibited from:
(a) Using the Foundation’s marks or brand elements without prior written consent;
(b) Registering or attempting to register any mark that is identical or confusingly similar to the Foundation’s marks;
(c) Altering, distorting, or misrepresenting the Foundation’s marks in any way;
(d) Using the Foundation’s marks in a manner that implies sponsorship, endorsement, or affiliation where none exists.

3.3 Any unauthorized use of the Foundation’s marks shall constitute infringement, dilution, and/or passing off under applicable law.


4. Limited License

4.1 Subject to strict compliance with this Policy, the Foundation grants the User a limited, non-exclusive, non-transferable, revocable license to access and use the Foundation’s services and content solely for personal, educational, or non-commercial purposes.

4.2 This license does not authorize the User to copy, distribute, sublicense, sell, exploit, reverse engineer, or otherwise commercially utilize the Foundation’s Intellectual Property.

4.3 The Foundation reserves the right to revoke this license at any time without notice in the event of breach or misuse.


5. Partner / Collaborator License

5.1 The Foundation may, at its sole discretion, enter into written agreements with partners, collaborators, educational institutions, corporate entities, NGOs, CSR bodies, or government agencies (“Authorized Partners”) granting them a limited, non-exclusive, revocable license to use certain Intellectual Property or brand assets for specific, approved purposes.

5.2 Such usage shall always be subject to:
(a) A formal written agreement or Memorandum of Understanding (MoU) with the Foundation;
(b) Compliance with the Brand Usage Guidelines issued by the Foundation from time to time;
(c) The Foundation’s right to revoke such permissions at any time, with or without cause.

5.3 No partnership, collaboration, or co-branding arrangement shall be implied or deemed to exist in the absence of a duly executed agreement.


6. Third-Party Content

6.1 The Foundation may display or make available third-party content, trademarks, software, APIs, or tools. Such content remains the property of its respective owners and is subject to their license terms.

6.2 The Foundation disclaims all liability for any third-party intellectual property rights.


7. Reporting Infringement

7.1 Any individual or entity claiming infringement of their intellectual property rights by the Foundation may submit a written notice to:

7.2 The notice must include sufficient details to identify the allegedly infringing material and evidence of ownership of the claimed intellectual property.


8. Enforcement & Remedies

8.1 Unauthorized use, reproduction, or exploitation of the Foundation’s Intellectual Property constitutes a material breach of this Policy and may subject the User to:
(a) Immediate suspension or termination of access to the Foundation’s services;
(b) Injunctive relief to prevent further unauthorized use;
(c) Claims for damages, costs, and legal fees;
(d) Civil and/or criminal proceedings under applicable laws.

8.2 The Foundation reserves all rights and remedies available at law and in equity to enforce its intellectual property rights.


9. Governing Law & Jurisdiction

9.1 This Policy shall be governed by and construed in accordance with the laws of India.

9.2 Any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts at Paschim Bardhaman, West Bengal, India.


10. Amendment & Updates

10.1 The Foundation reserves the right to amend, modify, or update this Policy at any time, without prior notice, to reflect changes in legal requirements, business operations, or organizational practices.

10.2 Any such amendments shall become effective immediately upon publication on the Foundation’s official website or other designated communication channels.

10.3 Continued use of the Foundation’s services or engagement with its platforms after the effective date of such amendments shall constitute acceptance of the updated Policy.
