1. Acceptance of Terms
By accessing, browsing, registering with, donating to, volunteering for, or otherwise using the services of Anshumat Foundation (“Foundation”, “we”, “our”, “us”), you agree to comply with and be bound by these Terms & Conditions. If you do not agree, please discontinue use of our services immediately.
2. Definitions
- “Foundation” – Anshumat Foundation, its trustees, employees, representatives, volunteers, and affiliates.
- “User” / “You” – Any individual or entity accessing, using, or engaging with the Foundation’s services.
- “Services” – Programs, initiatives, campaigns, digital content, learning materials, community events, donation platforms, and all offerings by the Foundation.
- “Donor” – Any individual or entity providing financial or in-kind contributions.
- “Volunteer” – Any individual offering services, time, or skills without monetary compensation.
- “Beneficiary” – Any person or community receiving support or assistance.
- “Digital Platforms” – The Foundation’s website(s), portals, mobile applications, and communication channels.
- “Applicable Law” – All laws, rules, and regulations of India, including but not limited to the IT Act, 2000, Income Tax Act, 1961, Companies Act, 2013, FCRA, 2010, and GDPR (where applicable).
3. Eligibility
- Users must be at least 18 years of age to engage in donations, volunteering, or agreements.
- Minors may participate in programs or campaigns under parental/guardian supervision.
- By using the Services, you represent that you have the legal capacity and authority to enter into this agreement.
4. Scope of Services
- Educational, vocational, and community development initiatives.
- Digital resources, awareness campaigns, and capacity-building programs.
- Volunteer and fellowship opportunities.
- Donation and sponsorship facilitation (monetary and in-kind).
- Events, training sessions, and mentorship programs.
- Technology-driven civic and social impact tools.
5. User Obligations
- Provide accurate and complete information during registration, donation, or volunteering.
- Use the Services only for lawful, non-commercial purposes.
- Respect intellectual property rights of the Foundation and third parties.
- Abstain from posting, transmitting, or engaging in harmful, defamatory, obscene, or unlawful content.
- Avoid misuse of the website, platforms, or donation systems.
6. Donations & Payments
- All donations made are voluntary, non-refundable, and non-transferable unless otherwise mandated by law.
- Donors may receive receipts, certificates, or acknowledgments as per legal and tax requirements.
- The Foundation is not responsible for errors due to incorrect payment information.
- All donations are used for charitable purposes, aligned with the Foundation’s mission.
- For corporate or foreign donations, compliance with FCRA and other regulations will apply.
7. Sponsorships & Partnerships
- Sponsorship agreements will be subject to separate MoUs/contracts.
- Sponsors may not use the Foundation’s name/logo without prior written approval.
8. Volunteers & Fellows
- Volunteers agree to abide by codes of conduct, confidentiality rules, and policies.
- The Foundation is not liable for any injury, loss, or damages during volunteering activities.
- No employer–employee relationship is created by volunteering.
9. Intellectual Property
- All content, logos, designs, documents, data, and digital material belong to the Foundation.
- Users may access and use content for personal, non-commercial purposes only.
- Reproduction, redistribution, or modification requires prior written consent.
10. Data Protection & Privacy
- User data may be collected, processed, and stored as per our Privacy Policy.
- Personal information will be used only for lawful purposes.
- Users consent to receiving communications via email, SMS, or other channels.
11. Prohibited Conduct
Users shall not:
- Use Services for commercial, political, or religious propaganda.
- Upload malicious code, spam, or harmful data.
- Impersonate another person or misrepresent affiliation.
- Engage in fraud, misappropriation, or unlawful financial activity.
12. Disclaimers
- Services are provided “as is” and “as available”.
- The Foundation does not guarantee uninterrupted, error-free, or virus-free access.
- No warranties (express or implied) are made regarding outcomes, suitability, or availability of Services.
13. Limitation of Liability
- The Foundation shall not be liable for indirect, incidental, or consequential damages.
- Maximum liability, if any, shall not exceed the amount directly donated by the User in the past 12 months.
14. Third-Party Links & Platforms
- Our Services may contain links to third-party websites or tools.
- We do not endorse, control, or assume responsibility for external content.
15. Termination & Suspension
- The Foundation may suspend or terminate access to Services at any time, with or without cause.
- Users may discontinue use of Services at any time.
16. Indemnification
You agree to indemnify and hold harmless the Foundation, its trustees, employees, and partners from any claims, damages, or losses arising from your use of Services, violation of terms, or infringement of rights.
17. Governing Law & Jurisdiction
- These Terms shall be governed by the laws of India.
- Courts in West Bengal, India shall have exclusive jurisdiction.
18. Amendments & Updates
- The Foundation reserves the right to modify these Terms at any time.
- Continued use of Services after updates implies acceptance of revised Terms.
19. Severability
If any provision of this policy is held invalid, the remaining provisions shall remain enforceable.
